Dutch Flowers Terms and Conditions

These terms and conditions (the “Terms and Conditions”) are the terms and conditions upon which Dutch Flowers in Lagos (“DFL”) makes this website available to you and any other services which are accessible on or via the “dutchflowersinlagos.nl” website.

DFL will treat each order for flowers as an offer by you to purchase the flowers subject to these Terms and Conditions.

To order flowers through this website you must be at least 18 years of age.

1. Products

1.1 All images, descriptive matter, specifications and advertising on the DFL website are for the sole purpose of giving an approximate description of the flowers. Whilst we endeavour to show an accurate colour image, you are advised that there may be variations in colour between the actual flowers you receive and the image that you see on your monitor or TV screen. We may from time to time vary the dimensions, specifications and quantities of items displayed on our website without prior notice.

1.2 Whilst DFL endeavour to only show items on the website that are in stock, the flowers are subject to availability. In the event of any supply difficulties, DFL reserve the right to substitute with a product of equivalent value and quality without notice.

1.3 In the event that DFL is unable to supply the selected flowers or any substitute flowers to you at all, DFL shall notify you as soon as possible and shall reimburse your payment in full and in any event not later than 5 workdays after the intended Delivery Date subject to clause 5.4. However, if DFL does not supply flowers, DFL will not be responsible for compensating you for any other losses which you may incur.

2. Prices

The price for the flowers will be as stipulated at the time when you placed your order. DFL deserves the right to make adjustments to the price to take account of any increase in, or the imposition of, any taxes or duties or if due to an error or omission the price published for the flowers on the website of DFL is wrong. DFL will inform you of the correct price and give you an opportunity to cancel the order. 3. Order and Payment

3.1 An order will only be processed if accompanied by full payment.

3.2 If you are experiencing any problems processing your order please call us on 08183440403 or email to info@dutchflowersinlagos.com.

3.3 We accept payment via bank transfer.

3.4 Once DFL receives your order, an email will be send to you confirming your order details. This email shall be directed to the emailadress you supplied DFL upon your order.

4. Registration

4.1 You will need to register with DFL to order flowers using this website. You are responsible for maintaining the confidentiality of your account user name and password and for preventing unauthorized access to your profile. You agree to accept responsibility for all activities that occur under your account or password. Please take all necessary steps to ensure that the user name and password is kept confidential and secure. Please inform us immediately if you have any reason to believe that your user name and/or password has become known to anyone else, or are being, or are likely to be, used in an unauthorized manner.

4.2 DFL reserve the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If DFL cancels an order, it will be without charge to you.

5. Delivery and pick up flowers

5.1 DFL will deliver the ordered flowers at a designated pickup point, Supermarket “Out of Eden” on Banana Island, Ikoyi, Lagos (“Pickup Point”).

5.2 The ordered flowers will be ready to pick up at the Pickup Point on the date selected during the online checkout procedure (“Selected Date”)

5.3 DFL can offer delivery options to certain locations other than the Pickup Point but on Ikoyi only. An additional fee will be charged.

5.4 After the order has been placed, DFL will endeavour to deliver the ordered flowers to the Pickup Point usually on the Selected Date (“Delivery Date”), but flowers are subject to availability and delay in delivery of flowers is sometimes outside of our control. DFL shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods unless caused by DFL’s negligence.

5.5 In case the Delivery Date will not be the Selected Date, DFL will inform you accordingly via the emailadress you supplied DFL upon your order.

5.6 In case the delivery will be delayed for more than 2 days you have the right to contact us and cancel your order. In this case DFL will refund any money paid by you for the flowers.

5.7 Because of the perishable nature of the ordered flowers, we advise you to pick up the flowers within 1 working day of the Delivery Date (“Pickup Date”). Picking up later than the Pickup Date will be considered as delay.

5.8 As soon as you have picked up the flowers at the Pickup Point, you will be responsible for them. If you delay picking up the flowers at the Pickup Point, DFL’s responsibility for everything other than damage due to our negligence will end on the Pickup Date.

6. Statutory rights

6.1 Because of the perishable nature of the flowers and in order to assist DFL in resolving any complaints quickly and to our mutual satisfaction, please make any complaint within 1 working day of the Pickup Date via the “contact-us-form” on the website.

6.2 If we are satisfied that your complaint is genuine, a suitable replacement or refund may be given. This does not affect your statutory rights as a consumer.

7. Disclaimer

7.1 Whilst DFL agrees to use our reasonable endeavours to ensure that the DFL online website is fully operational and error-free, DFL cannot guarantee that this will always be the case. DFL therefore accepts no responsibility or liability for any defects or interruption of our service.

7.2 DFL shall be released from our obligations under these Terms and Conditions in light of any event beyond our reasonable control, (i.e.: acts of god, civil commotion, flood, fire) which renders the provision of the DFL service impossible or impractical.

8. General

8.1 Failure by DFL to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these Terms and Conditions.

8.2 The contract between us shall be governed by the laws of the Netherlands and any dispute will be resolved exclusively in the courts of the Netherlands. DFL operates a complaints handling procedure which DFL will use to try to resolve disputes when they first arise.

8.3 DFL reserves the right to supplement and amend the Terms and Conditions at any time without prior notice to you.
